Cornered
After years of saving up, Mike could finally build his dream home. He found the ideal place to build which was a corner lot. The Homeowners Association Board affirmed the plan based on Mike's presentation which had the driveway coming out on the street in front of the house. Eventually Mike, decide to change the plans meaning the driveway would need to come out onto the street closest to the garage. The Board threatened him with a cease and desist letter. Mike retaliated by suing the Board for declaratory judgment claiming they do not have the authority to tell him where their driveway can be placed.
